At Gaby’s we love happy customers! We promise to do all we reasonably can to sort out any problems. But both you and we need agreed terms of trade to provide us both with security, privacy and legal protections. So here they are …

These terms and conditions (the Terms) regulate the business relationship between you and us. By using Our Website in any way, or by buying from us, you agree to be bound by them.
These Terms include Gaby’s Payment and Shipping policies, Returns policy and Privacy policy.
We may amend these Terms from time to time. If you continue to use this website after we have amended these Terms you will have been deemed to have accepted such changes.
No person under the age of 18 years may purchase Goods. If that applies to you - we look forward to seeing you again when you are over 18.

Registration:

To make a purchase on this website you must be registered and to do this we require certain information from you. We rely on this information to stay in touch with you including sending you your order and communicating any matters relating to it. Please ensure that you provide us with accurate information. Information about how we collect, use and store your personal information can be found in our Privacy Policy below.
When we communicate with you we do so by email. You agree that email communications are contractually binding. If you use our website you are responsible for maintaining the confidentiality of your account and password and for preventing any unauthorised person from using your account.

Website Descriptions and Images:

We endeavour to always be accurate in descriptions and colours of garments, but we cannot guarantee that descriptions and images accurately depict the actual product. Website images can vary in colour and detail when viewed on different screens. If you are unhappy with any purchase having relied on our description or images please return it for a refund/exchange as per our Refund Policy below.

Prices:

Prices on our website are in New Zealand dollars (NZD) and include GST (Goods & Services Tax of 15%). We endeavour to always be accurate in our pricing, but mistakes can occur. If we discover an error in the pricing of any item you have ordered we will inform you as soon as possible and give you the option of confirming your order at the correct price, or receiving a full refund.
We reserve the right to alter prices at any time for whatever reason.
Sale prices on items may vary between our physical and online store. Sale prices are not available in conjunction with any other special offer.

Stock Availability:

Our website relies on our computer system being accurate in its stock data base and from time to time mistakes will be made. We operate a physical store also and stock may be suddenly unavailable if another customer has just purchased in-store. We endeavour to minimise such occurrence by removing your ordered items from the shop racks as soon as we receive your order. However, if we no longer have an ordered item in stock we will advise you as soon as possible and make a full refund. Because our stock is seasonal, many items are not available for us to reorder.

Payment:

The price payable for the items you order is clearly set out on our website. We accept Visa and Mastercard payments. Card payments are not processed through pages controlled by us, nor do we store your credit card details. We use the secure hosted payment solution from Payment Express to process online orders. Please see here for the Payment Express terms and conditions. The payment process is protected by SSL (Secure Socket Layer) and payment details are encrypted. In using this payment solution you warrant that you are over 18 and are the card holder or have the authority of the card holder.
You can also choose PartPay as a means of payment. This allows you to spread your payment over 4 instalments. PartPay is an external provider. Please see here for their terms and conditions. You will need to set up a PartPay account and in order to do this you need a current NZ Driver’s Licence.

Order Confirmation:

On receiving your order and payment we will send an automatically generated confirmation of your order to your email address.
We will also send an email when your item is dispatched. This will include tracking information.

Once you have placed an order it cannot be cancelled once it has been shipped. Contact us by phone to check the status.  If however, you are not satisfied with your order please contact us on ph 09 425 9970 (International +64 9425 9970).

Privacy:

Gaby’s collects and holds personal information such as names, email addresses, physical addresses and phone numbers of customers who register on this website, order on this website or join any loyalty program. In so registering, ordering or joining you agree to provide such information and have it stored in Gaby’s data base. Credit card details will never be collected or stored by Gaby’s. You are entitled to obtain from Gaby’s details of any information held about you, request that changes be made or that the information be deleted.

Gaby’s may from time to time use your personal details for promotional purposes, for instance to email you about special offers or sales or new stock arrivals. If you do not wish to receive such material you are able to opt out at any time. Gaby’s will never pass on held personal information to third parties, unless required to do so by law.

Intellectual Property:

We will defend the intellectual property rights in connection with our goods and our website, including copyright in the content whether provided by us or any other content provider (including copyright in text, graphics, logos, icons, and images). You may not use our name or logos or content on any other website.

You may download or copy content for your personal use only.
